Terms of sale and software licence

These terms apply when you buy or trial EOMeasy. They are written to be read, not to be survived. If anything here is unclear, email hello@eomeasy.com and we will explain it plainly.

Who you are contracting with

EOMeasy is supplied by EGB Digital Pty Ltd (ABN 33 640 377 457), referred to below as "we" and "us". "You" means the organisation that buys or trials the licence.

Licence grant

We grant you a non-exclusive, non-transferable licence to use EOMeasy for your own business purposes, for as long as your licence is current.

The annual site licence covers up to three machines at one site, being the operation whose volumes you reconcile; a second operation needs its own licence, wherever the machines sit. For an organisation that reviews or certifies volumes produced by others rather than producing its own, the same annual licence instead covers up to three machines at one office, with no limit on the projects reviewed. The monthly Lite plan covers one machine. Each activation is locked to the machine it is activated on and carries a 30-day offline grace period, so a dropped connection at month-end never stops a run.

You may not sublicense, rent, resell or redistribute the software, or share your licence key outside your organisation. You may not reverse engineer, decompile or disassemble it, except to the extent the Copyright Act 1968 (Cth) permits you to do so for interoperability or error correction. Those statutory rights are yours and nothing here removes them.

We own the software and everything in it. You own your survey data, and you own the reports EOMeasy produces from it. We claim nothing in your data or your output.

Term, renewal and cancellation

The site licence runs for twelve months from purchase. The Lite plan runs month to month and you can cancel at any time, which stops it at the end of the paid month.

If a licence lapses, the software stops running new reports. Everything you have already produced stays on your machine and stays yours, in formats that do not need us: PDF reports and CSV files you can open with anything.

The 14-day money-back guarantee

Buy either plan, run a real month-end on your own surfaces, and if it does not reconcile against your package or does not suit how you work, email us within 14 days and we will refund you in full. This guarantee sits alongside your rights below, and nothing in the rest of these terms reduces it.

Accuracy and inputs

Volumes are computed from the survey surfaces supplied and are only as accurate as those surfaces, their registration and the boundaries used. Check figures against site records before relying on them for payment or reporting.

To be specific about the division of work: EOMeasy computes cut, fill and net from the surfaces and boundaries you give it, and reports warnings when an input is degraded in a way it can detect. It does not verify the provenance of a survey, its registration, its datum or its control, and it cannot know whether the surface you pointed it at is the one you meant. Those remain yours to check, the same way they would be if you ran the volumes in your own package.

We test every release against the native figures produced by established survey packages, and publish what those comparisons show. Those results describe the software's behaviour on the data we tested. They are not a promise about any particular survey of yours.

Our liability, and your rights that cannot be excluded

Our goods and services come with guarantees under the Australian Consumer Law that cannot be excluded. Nothing in these terms limits or removes them. Depending on the failure, you may be entitled to a replacement, a refund, or compensation for reasonably foreseeable loss.

Beyond those guarantees, and to the extent the law permits, our liability for any claim connected with EOMeasy is limited, at our option, to resupplying the software or refunding the fees you paid for it in the twelve months before the claim.

Again to the extent the law permits, we are not liable for loss of profit, loss of production or indirect loss, and we are not liable for decisions made on figures that were not checked against site records as described above.

Privacy

The application sends us nothing except a licence check. What we collect through the website and when you buy is set out on our privacy page.

Governing law

These terms are governed by the laws of Queensland, Australia, and the courts there have jurisdiction.

Changes

We may update these terms for new purchases. The terms that apply to you are the ones published when you bought your current licence period, and we will not change them under you mid-term.
